Legal Expert: Don Lemon’s Legal Battle Could Have Devastating Unintended Consequences for Abortion Clinics

Former CNN host Don Lemon is pursuing an unusual legal strategy in his ongoing court case that some observers say could backfire on progressive causes he has long supported.

In January, Lemon took part in a group that disrupted a church service in Minneapolis, creating significant disruption and drawing federal civil rights charges. The former network anchor appeared in court on August 7, where he argued that the case against him was unfair and should be dismissed.

A key element of that defense seeks to invalidate the portion of the Freedom of Access to Clinic Entrances Act (FACE Act) that shields houses of worship from interference. The 1990s-era law was designed to prevent physical obstruction, threats, and harassment at both reproductive health facilities and places of religious practice.

According to Jeremy Dys, senior counsel at First Liberty Institute, successfully striking down the religious protections could open the door to broader challenges against the entire statute. That would include the sections that guard abortion clinics. Dys described the potential outcome as one of the greater ironies imaginable: Lemon helping dismantle the very legal shield created to protect those clinics. He expressed surprise that Lemon would pursue a path that risks such collateral damage to a law long used to defend abortion facilities nationwide.

Critics of the FACE Act have noted that successive administrations have applied it selectively. Under the prior administration, enforcement focused heavily on pro-life demonstrators and counselors near clinics while largely overlooking disruptions at churches or pregnancy centers.

Lemon’s team is also advancing a separate argument that the charges amount to targeted harassment by the current presidential administration.
